Right of withdrawal

Right of withdrawal for services and products from PurePC

 

 

In accordance with applicable law (Section 312g, Paragraph 2, No. 1 and No. 3 of the German Civil Code (BGB) and other relevant provisions), we would like to inform you about your right of withdrawal and its limitations for PurePC services and products.

 

1. Right of withdrawal for services

According to Section 312g Paragraph 2 No. 1 and No. 3 of the German Civil Code (BGB), there is no right of withdrawal if:

  • a contract for the provision of services has been concluded and

  • the execution has begun after the customer has given his express consent and has become aware of the loss of the right of withdrawal.

Conclusion of contract: A contract is concluded when the customer places an order or orders a product (verbally, by telephone or in writing; § 145 ff. BGB).
Start: The service usually begins immediately after receipt of the device or after the customer has expressly agreed to it.
Expiry: The right of withdrawal expires with the start of execution, in particular if the device has already been received (Section 356 (4) BGB).
Exception: If execution has not yet begun and the device has not been received, the contract can be revoked within 7 days (§ 355 BGB).

 

2. Right of withdrawal for products (e.g. pre-built PCs)

  1. Customers have the right to cancel the purchase contract within 14 days without giving reasons (Section 355 (1) BGB in conjunction with Article 246a (1) 2 EGBGB), provided the product is unused, unconnected and in its original packaging.
    Restrictions for custom-made products: If custom production has already begun, reasonable compensation for the work already performed can be demanded (Section 357, Paragraphs 1 and 7 of the German Civil Code). Costs for materials already procured or processed are transparently disclosed.

 

3. Warranty and liability for self-repair attempts

If the customer performs repairs on the device independently, any warranty and liability for the device are voided (Section 434 (1) Sentence 2 No. 2 of the German Civil Code). Repairs by PurePC are still possible after such interventions, but may incur additional standard costs (Section 280 of the German Civil Code). These costs arise from the diagnosis and repair of the damage and will be communicated transparently in advance.

 

4. Shipping, liability and general information

  • All devices are shipped insured by PurePC. Liability for transport damage is transferred to the shipping service upon handover to the shipping service provider (Section 447 of the German Civil Code). Obvious damage must be reported within 7 days (Section 377 of the German Commercial Code), otherwise the right of withdrawal is void.
    To exercise your right of withdrawal, a clear declaration by email, post, or via our online form is required (Section 355 (1) of the German Civil Code (BGB). Refunds will be made immediately, at the latest within 14 days of receipt of the withdrawal notice (Section 357 (1) of the German Civil Code).
